Conditions governing the use of this website and the commercial relationship between Marengo Decor Atelier and its clients.

Effective from May 2026

By accessing and using marengodecor.com.br, or by requesting a quote, scheduling a visit or initiating any commercial relationship with Marengo Decor Atelier, the visitor or client declares having read, understood and agreed to these Terms & Conditions.

This document complements the Atelier Policy — which describes the operational process — and the Privacy Policy — which covers the processing of personal data. In the event of conflict between documents, the more specific one for the situation prevails.

1. Definitions

Atelier

Marengo Decor Atelier, operated by Zafalon Cortinas e Decorações Ltda., CNPJ 31.976.755/0001-50, based in São Paulo, SP, Brazil.

Client

Any individual or legal entity that visits the website, requests a quote, approves an order or maintains any commercial relationship with the atelier.

Architect / Partner

Architecture or interior design professional who represents the client or acts as an intermediary in the project.

Quote

Formal commercial proposal issued by the atelier, valid for 15 calendar days, describing products, materials, prices and conditions.

Deposit

Advance payment that formalises the order and authorises the start of production. Without the deposit, no piece enters production.

Order

Piece or set of pieces produced to measure and by hand, according to specifications approved by the client in the quote.

2. Website use

The website marengodecor.com.br is an institutional channel presenting the atelier. It does not conduct online sales, has no shopping cart and does not process payments. Use of the website is subject to the following conditions:

  • All content available — texts, images, photographs, videos, logos and visual identity — is the exclusive property of Marengo Decor Atelier and protected by intellectual property legislation.
  • Reproduction, copying, distribution or commercial use of any website content without prior written authorisation from the atelier is prohibited.
  • The website is intended for persons aged 18 or over, or for minors duly represented by their legal guardians.
  • The atelier reserves the right to modify, suspend or shut down the website at any time without prior notice.

3. Intellectual property

All content published on the website is protected by Brazilian copyright law (Law nº 9.610/1998) and applicable industrial property legislation:

  • Photographs of products, environments and artisanal details are authored works of the atelier or commissioned photographers. Any use without authorisation constitutes copyright infringement.
  • The name Marengo Decor Atelier, its visual identity, logo and other brand elements are assets of the atelier. Unauthorised use for commercial purposes or to create confusion with third parties is prohibited.
  • References to the website or atelier in editorial publications, portfolios of partner architects or press outlets are permitted provided they include correct credit: Marengo Decor Atelier — marengodecor.com.br.

4. Commercial relationship

The commercial relationship between the client and the atelier is governed by the following principles:

  • The commercial relationship begins only upon formal approval of the quote and payment of the deposit. Showroom visits, consultations and quotes create no purchase obligation for either party.
  • Each order is unique and produced according to the approved specifications. The atelier does not hold stock of ready-made pieces for immediate delivery.
  • Approval of the quote by the architect, in projects mediated by an architecture professional, binds the architect or their firm, unless there is an express written agreement to the contrary documented before approval.
  • Changes to specifications after approval are subject to a new quote and, if production has already begun, may incur additional cost for material already processed.
  • The atelier reserves the right to decline orders that are not compatible with its technical capacity, quality standards or production schedule, without obligation to provide justification.

5. Payment

  • The standard model is a 50% deposit upon quote approval and 50% upon delivery and installation. Differentiated conditions may be negotiated and will be stated explicitly in the quote.
  • Instalment plans beyond the standard model are subject to a financial surcharge, informed in advance in the quote.
  • Non-payment of the balance on the agreed date may suspend delivery and installation until regularisation, without prejudice to any late payment charges.
  • Prices are expressed in Brazilian reais (BRL). Orders with imported materials may have the final value adjusted for exchange rate variation exceeding 5% between the quote date and the material acquisition date, with prior notice to the client.

6. Cancellation and withdrawal

As this involves artisanal made-to-order production with specific materials, cancellation conditions are as follows:

  • Cancellation before production begins: partial refund of the deposit, less costs already incurred (technical visit, material acquisition, preparatory labour).
  • Cancellation after production has begun: deposit is non-refundable. If costs already incurred exceed the deposit, the client is responsible for the difference.
  • Pieces made to measure with exclusive specifications — imported fabric, custom colour or pattern, personalised dimensions — are not subject to the 7-day right of withdrawal provided for in Article 49 of the Brazilian Consumer Protection Code, as they fall under the exception for personalised products (Article 49, sole paragraph).
This limitation on the right of withdrawal is supported by Article 49, sole paragraph, of the Consumer Protection Code and by the consolidated case law of the Superior Court of Justice on made-to-measure products.

7. Responsibilities and limitations

The atelier is responsible for the artisanal quality of pieces produced according to approved specifications. The following are excluded from the atelier's liability:

  • Incompatibilities arising from incorrect measurements provided by the client or architect, in cases where the technical verification visit was waived.
  • Damage caused by improper use, incorrect washing, exposure to adverse environmental conditions or mishandling after delivery.
  • Alterations made by the client or third parties without the atelier's express authorisation.
  • Delays caused by force majeure: unavailability of imported materials, transport strikes, natural disasters, pandemics or other events outside the atelier's control. In such situations, the atelier will notify the client immediately and agree a new date without penalty.

8. Protection against misuse and fraud

Marengo Decor Atelier takes measures to protect its clients and the atelier against fraudulent practices. We alert you:

  • The atelier does not send payment slips, Pix requests or payment links through unsolicited channels. Any charge must be confirmed directly with the team at contato@marengodecor.com.br or via the official WhatsApp before payment.
  • No atelier representative will request bank details, passwords or financial information by phone, unsolicited email or direct message on social networks.
  • If you receive suspicious communication in the name of Marengo Decor Atelier, contact the atelier immediately through official channels before taking any action.
  • The atelier accepts no liability for payments made to bank accounts not confirmed through official channels. Bank details must always be verified before any transfer.
If in doubt, do not pay. Contact us first.

9. Privacy and personal data

The processing of personal data collected through the website and the atelier's service channels is governed by the Privacy Policy, available on this website, in compliance with Brazil's General Data Protection Law — LGPD (Law nº 13.709/2018).

Acceptance of these Terms & Conditions also implies acceptance of the Privacy Policy. If you do not agree with its terms, you should refrain from providing personal data to the website.

10. Changes to these Terms

The atelier reserves the right to update these Terms & Conditions at any time to reflect operational, legal or regulatory changes. The current version will always be available on this page, with the update date indicated. Continued use of the website or maintenance of a commercial relationship after new versions are published implies acceptance of the updated terms.

11. Applicable law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Consumer Protection Code (Law nº 8.078/1990), the Civil Code (Law nº 10.406/2002) and the Internet Civil Framework (Law nº 12.965/2014). To resolve any disputes not resolved directly between the parties, the courts of São Paulo, SP, Brazil are elected as the competent jurisdiction, with waiver of any other, however privileged.
